Johnson & Johnson, the parent company of ASR hip implant manufacturer DePuy Orthopedics, Inc., first settled the ASR cases in August 2013. At the time, the company committed to spending $2.5 billion dollars to compensate individuals who had been harmed by defective ASR hip implant devices.
The initial settlement offered more than 7,000 individuals $250,000 each with additional monies being awarded to individuals who were severely injured. The initial settlement allowed patients who underwent revision surgery to replace or remove the defective implant devices on or before August 31, 2013, to file a claim.
Individuals whose defective hip devices were removed after August 31, 2013, were not eligible to recover under the original settlement. Those patients and their attorneys continue to pursue a suit against Johnson & Johnson in a multi-district litigation proceeding.
Recently, Bloomberg News reported that Johnson & Johnson had capitulated and decided to increase the number of individuals who could file a claim with the settlement fund.
The company extended the deadline for revision surgeries from August 2013 to January 31, 2015. This extension allows an additional 1,400 patients to file a claim.
Eligible patients will receive $300,000 each with more forthcoming if they were severely injured according to factors listed in the settlement agreement. The 1,400 additional patients will cost Johnson & Johnson $420 million bringing the total cost of the recalls and litigation to more than $4 billion.
Worldwide, Johnson & Johnson was forced to recall more than 96,000 hip implant devices. The devices were recalled because they caused a dangerous condition called metallosis in patients after the metal used in the devices became corroded.
The devices had a 40% failure rate within five years. This accounts, in large part, for how expensive these settlements have been.
